{"id":276,"date":"2018-08-06T01:24:03","date_gmt":"2018-08-06T01:24:03","guid":{"rendered":"http:\/\/getshopsafe.com\/?page_id=276"},"modified":"2026-08-12T22:41:18","modified_gmt":"2026-08-12T22:41:18","slug":"user-agreement","status":"publish","type":"page","link":"https:\/\/getshopsafe.com\/index.php\/user-agreement\/","title":{"rendered":"User Agreement and Service Agreement"},"content":{"rendered":"<p>Safety First Terms of Use &amp; Subscription Agreement<\/p>\n<p>Effective Date: 8\/01\/2026<\/p>\n<p>These Terms of Use &amp; Subscription Agreement (\u201cTerms\u201d) govern access to and use of Safety First, provided by A&amp;G Safety Solutions, LLC (\u201cSafety First,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d).<\/p>\n<p>By purchasing a subscription, creating an account, or using Safety First, the school, school district, teacher, or other subscriber (\u201cSubscriber\u201d) agrees to these Terms.<\/p>\n<p>1. Safety First Services<\/p>\n<p>Safety First provides online educational materials designed to assist schools and instructors with safety education, including equipment identification, safety and operation instruction, assessments, certificates, instructional materials, and related resources.<\/p>\n<p>Access to Safety First is provided only during an active subscription period and is subject to these Terms.<\/p>\n<p>2. Educational Use and Teacher Responsibility<\/p>\n<p>Safety First is a supplemental educational resource. It does not replace teacher instruction, professional judgment, hands-on training, or direct student supervision.<\/p>\n<p>Schools and instructors remain responsible for:<\/p>\n<p>Providing appropriate instruction on the safe use and operation of tools, machinery, and equipment.<br \/>\nSupervising students whenever tools, machinery, or equipment are being used.<br \/>\nImmediately stopping unsafe practices or behavior.<br \/>\nFollowing manufacturer instructions, school policies, applicable laws, and established safety procedures.<br \/>\nDetermining whether each student is physically and educationally prepared and qualified to operate a particular piece of equipment.<br \/>\nProviding any additional instruction or testing necessary for equipment located in their individual laboratory or facility.<\/p>\n<p>Completion of a Safety First lesson, assessment, performance test, or certificate does not, by itself, authorize or qualify a student to operate equipment without instructor approval and supervision.<\/p>\n<p>3. Student Testing and Certificates<\/p>\n<p>Teachers are responsible for appropriately supervising student assessments and maintaining the integrity of testing.<\/p>\n<p>Safety First may generate certificates or electronic records showing completion of designated training requirements. Schools and instructors should maintain appropriate student safety-training records in accordance with their own policies and applicable requirements.<\/p>\n<p>Certificates indicate completion of designated Safety First requirements. They are not professional certifications, licenses, or guarantees that a student can safely operate equipment without additional instruction and supervision.<\/p>\n<p>4. Accounts and Access<\/p>\n<p>Each authorized teacher or user should use their own account credentials.<\/p>\n<p>Subscribers are responsible for protecting account information and preventing unauthorized access.<\/p>\n<p>Account credentials may not be sold, transferred, publicly distributed, or shared with individuals who are not authorized under the school&#8217;s subscription.<\/p>\n<p>Schools and teachers are responsible for activities performed through their accounts and should notify Safety First if they become aware of unauthorized access.<\/p>\n<p>5. Student Information and Privacy<\/p>\n<p>Safety First may collect and maintain information necessary to provide the service, including account information, class enrollment information, assessment results, completion records, and other information generated through use of the platform.<\/p>\n<p>Safety First will use reasonable measures to protect information maintained through the service and will use student and school information for legitimate educational, administrative, technical-support, security, and service-related purposes.<\/p>\n<p>Schools are responsible for ensuring that their use of Safety First complies with applicable school policies and student privacy requirements.<\/p>\n<p>Additional information regarding data collection and use may be provided in the Safety First Privacy Policy.<\/p>\n<p>6. Subscription Term<\/p>\n<p>Unless otherwise stated on a quote, invoice, purchase order, or other written agreement, Safety First subscriptions operate on a school-year subscription period of July 1 through June 30.<\/p>\n<p>Access may be limited, suspended, or disabled when a subscription expires or when payment remains outstanding.<\/p>\n<p>Subscription pricing and the number of authorized teachers, schools, or other users will be established by the applicable quote, invoice, or written agreement.<\/p>\n<p>7. Payment<\/p>\n<p>Subscribers agree to pay the fees shown on the applicable quote or invoice.<\/p>\n<p>Unless otherwise agreed in writing, invoices are due within 30 days.<\/p>\n<p>Safety First may suspend access for accounts with past-due balances after reasonable notice to the Subscriber.<\/p>\n<p>Except where otherwise required by law or agreed to in writing, subscription fees are non-refundable after service has been activated.<\/p>\n<p>8. Safety First Content and Intellectual Property<\/p>\n<p>Safety First and its educational materials\u2014including lessons, assessments, questions, graphics, videos, worksheets, certificates, instructional materials, website content, and other resources\u2014are owned by or licensed to A&amp;G Safety Solutions, LLC and are protected by applicable intellectual-property laws.<\/p>\n<p>An active subscription provides a limited right to use these materials for authorized educational purposes within the subscribing school or organization.<\/p>\n<p>Unless Safety First provides written permission, users may not:<\/p>\n<p>Sell or commercially redistribute Safety First materials.<br \/>\nPublicly post or publish assessments, answer keys, or protected instructional materials.<br \/>\nCopy or distribute substantial portions of Safety First content outside the subscribing school or organization.<br \/>\nShare account access with unauthorized schools or users.<br \/>\nAttempt to bypass security or subscription restrictions.<br \/>\nReproduce or modify Safety First materials for resale or competing commercial products.<\/p>\n<p>Teachers may use and reproduce downloadable materials specifically provided for classroom use with their authorized students during the subscription period.<\/p>\n<p>9. Website Availability<\/p>\n<p>Safety First will make reasonable efforts to maintain reliable access to its website and services.<\/p>\n<p>However, uninterrupted access cannot be guaranteed. Temporary interruptions may occur because of maintenance, updates, internet outages, hosting problems, third-party services, technical failures, security concerns, or circumstances beyond our reasonable control.<\/p>\n<p>Safety First may temporarily restrict access when reasonably necessary to maintain, update, secure, or repair the service.<\/p>\n<p>10. Accuracy of Educational Materials<\/p>\n<p>Safety First makes reasonable efforts to provide accurate and useful educational information. However, tools, equipment, manufacturers&#8217; recommendations, safety standards, regulations, and industry practices may change.<\/p>\n<p>Schools and instructors should always consider the manufacturer&#8217;s current instructions and warnings for the specific equipment being used and comply with applicable laws, regulations, and school policies.<\/p>\n<p>If a user identifies a potential error or outdated item in Safety First materials, we encourage the user to contact us so that it can be reviewed.<\/p>\n<p>11. Disclaimer<\/p>\n<p>Safety First is provided as an educational resource and is not a substitute for professional instruction, instructor supervision, manufacturer requirements, workplace safety requirements, or applicable laws and regulations.<\/p>\n<p>To the fullest extent permitted by law, A&amp;G Safety Solutions, LLC does not guarantee that use of Safety First will prevent accidents, injuries, equipment damage, or other losses.<\/p>\n<p>The school and its instructors retain responsibility for their laboratory, students, equipment, instruction, supervision, and determination of whether a student may operate equipment.<\/p>\n<p>12. Limitation of Liability<\/p>\n<p>To the fullest extent permitted by applicable law, A&amp;G Safety Solutions, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use Safety First.<\/p>\n<p>To the fullest extent permitted by law, A&amp;G Safety Solutions, LLC&#8217;s total liability arising from a Subscriber&#8217;s use of Safety First will not exceed the amount paid by that Subscriber for the applicable Safety First subscription during the twelve months preceding the event giving rise to the claim.<\/p>\n<p>Nothing in these Terms limits liability where such limitation is prohibited by applicable law.<\/p>\n<p>13. Suspension or Termination<\/p>\n<p>Safety First may suspend or terminate access when reasonably necessary because of:<\/p>\n<p>Expiration or nonpayment of a subscription.<br \/>\nUnauthorized account sharing or distribution of materials.<br \/>\nAttempts to circumvent platform security.<br \/>\nMisuse of Safety First content.<br \/>\nIllegal activity.<br \/>\nMaterial violation of these Terms.<\/p>\n<p>When practical, Safety First will provide reasonable notice and an opportunity to correct the issue before terminating access.<\/p>\n<p>14. Changes to the Service or These Terms<\/p>\n<p>Safety First may periodically update its website, educational materials, features, or these Terms.<\/p>\n<p>Material changes to these Terms will be communicated through reasonable means, such as the Safety First website, platform, or email.<\/p>\n<p>Continued use of Safety First after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.<\/p>\n<p>15. Governing Law<\/p>\n<p>These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.<\/p>\n<p>Any legal provision that cannot lawfully be limited or waived under applicable law will remain subject to those applicable legal requirements.<\/p>\n<p>16. Entire Agreement<\/p>\n<p>These Terms, together with any applicable quote, invoice, purchase order accepted by Safety First, Privacy Policy, or other written agreement between Safety First and the Subscriber, constitute the agreement governing use of the service.<\/p>\n<p>If a separately signed written agreement expressly conflicts with these Terms, the terms of that signed agreement will control to the extent of the conflict.<\/p>\n<p>17.
